Terms of Service

You must be at least 18 years of age and a licensed real estate professional, an employee or contractor of a licensed real estate brokerage, or otherwise authorized to use AI-staged property images in your business. By using the Service, you represent that you meet these requirements.

Accounts on the Service are provisioned by StageGenieAI administrators. Self-signup is not enabled. To use the Service, you must be granted credentials by an administrator. You agree to:

• Use the credentials only for the agency they were issued to
• Keep your credentials secure and not share them outside your agency
• Notify us immediately of any unauthorized use of your account
• Provide accurate information when entering listings or other content

We reserve the right to suspend or terminate accounts that violate these Terms.

The Service is currently offered to selected agencies as part of a pilot program. Access is provided free of charge during the pilot. We reserve the right to introduce paid plans, modify usage limits, or end the pilot program at any time with reasonable notice. We may also impose technical limits on uploads, stagings, or storage to maintain service quality.

Staged images generated by the Service are produced by artificial intelligence and are not photographs. You acknowledge that:

• AI-staged images may contain visual artifacts, inaccuracies, or stylization that differs from physical reality
• Furniture, decor, fixtures, finishes, and other elements added by the AI are illustrative and do not represent any physical property
• You are solely responsible for ensuring that any use of AI-staged images in property listings complies with your local MLS rules, real estate licensing requirements, and applicable consumer-protection law (including disclosure that the images are virtually staged)
• Every staged image generated by the Service includes a “Visually enhanced using StageGenieAI” disclosure on-screen and burned into downloaded files. You may not remove, alter, or obscure this disclosure on any image you publish

StageGenieAI is not responsible for compliance issues, complaints, or claims arising from your use of AI-staged images.

You agree not to:

• Use the Service for any unlawful purpose
• Upload images you do not have the right to use (e.g. photos owned by other parties without permission)
• Upload images that contain identifiable individuals without their consent
• Upload sexually explicit, violent, or otherwise inappropriate content
• Attempt to access another agency’s listings, rooms, or staged images
• Reverse engineer, decompile, or attempt to derive the source code of the Service
• Use automated tools, bots, or scripts to access the Service
• Interfere with or disrupt the Service’s servers or infrastructure
• Attempt to gain unauthorized access to other users’ accounts

The Service, including its design, code, branding, and interface, is owned by StageGenieAI and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your agency’s real estate business.

You retain ownership of the original property photos you upload and of the AI-staged images generated from them. You grant us a non-exclusive, worldwide license to store, process, and display those images solely for the purpose of operating the Service for your account. We do not claim ownership of your content and do not use it to train AI models or for any purpose other than providing the Service to you.

You are responsible for ensuring that you have the rights necessary to upload any image to the Service.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, StageGenieAI disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy, completeness, photorealism, or marketability of any AI-staged image generated by the Service.

To the fullest extent permitted by law, StageGenieAI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of revenue, loss of goodwill, or losses arising from listings that fail to sell or disputes with buyers.

In no event shall our total liability to you exceed the amount you have paid to us in the 12 months preceding the claim, or $100 USD if you have not made any payments.

You agree to indemnify and hold harmless StageGenieAI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party (including image rights, privacy rights, or MLS rules)
• The publication or use of AI-staged images you generate through the Service

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Stored data may be retained according to our data retention policy described in the Privacy Policy.

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in New Jersey.
